Terms of Use Introduction
These Terms of Use apply to all clients of MarketingStratego.com, a remote strategic marketing consulting firm, who purchase custom and turnkey marketing strategies, services and solutions from our company. These terms govern the resolution of any disputes that may arise between clients and MarketingStratego.com, and set forth the procedures for filing and resolving complaints.
1. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which MarketingStratego.com is located, without giving effect to any choice or conflict of law provisions.
2. Dispute Resolution
In the event of a dispute between a client and MarketingStratego.com, the parties agree to first attempt to resolve the dispute through informal negotiations. If the parties are unable to resolve the dispute through informal negotiations, the parties agree to resolve the dispute through binding arbitration in accordance with the rules of the American Arbitration Association.
3. Language
The language of the arbitration shall be English.
4. Jurisdiction
The place of arbitration shall be the jurisdiction in which MarketingStratego.com is located.
5. Limitation of Liability
In no event shall MarketingStratego.com be liable for any damages, including, but not limited to, direct, indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with a client’s use of our turnkey (pre-made) marketing strategies, custom strategies, custom services, custom solutions or these Terms of Use.
6. Limitation of Time to File Claims
Any action arising out of or related to these Terms of Use or a client’s use of our turnkey (pre-made) marketing strategies, custom strategies, custom services or custom solutions must be filed within thirty (30) days after the cause of action arose, or it shall be forever barred.
7. Indemnification
The client agrees to indemnify and hold MarketingStratego.com and its affiliates, officers, agents, and employees harmless from any claims, liabilities, damages, or expenses arising out of or in connection with the client’s use of our services or these Terms of Use.
8. Entire Agreement
These Terms of Use constitute the entire agreement between the client and MarketingStratego.com with respect to the subject matter hereof, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the subject matter hereof.
9. Severability
If any provision of these Terms of Use is found to be unenforceable, the other provisions shall remain in full force and effect.
10. No Waiver
The failure of MarketingStratego.com to enforce any right or provision of these Terms of Use shall not be deemed a waiver of such right or provision.
11. Assignment
The client may not assign these Terms of Use or any of its rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of MarketingStratego.com, and any attempted assignment without such consent shall be null and void.

13. Client agrees to be bound by these Terms of Use
By using MarketingStratego.com’s services, the client agrees to be bound by these Terms of Use for International Complaints. If the client does not agree to these Terms of Use, they should not use our services.
